Abstract

This paper analyzes the profile of contemporary constitutions. It seeks to investigate why contemporary constitutions have been called “transnational constitutions”. Its purpose is to provide an answer to this question through the results of several important empirical studies carried out in recent years, correlating these findings with the participatory constitution making. In other words, it investigates the relationship between the content of the constitutions and the popular will. It concludes that political capture greatly increases the risk that the outcome of the constituent process, however participative it may have been, is quite disappointing and disappointing, with alienated, sham, unpopular, long-winded and long-lasting constitutions. For this reason, it also concludes that a reflection on what a participatory constitution making really should be, starting with the very idea of participation.
