A inevitável mutabilidade dos litígios coletivos e estruturais

Neste artigo, apresenta-se formulação teórica aos litígios coletivos, por intermédio de sua apreciação transdisciplinar jurídico-sociológica. Elegendo-se como referencial teórico a abordagem sociológica Emergentista, no que tange ao seu entendimento explicativo-causal a respeito do potencial transformativo de fenômenos sociais (categoria à qual se enquadrará o gênero dos litígios coletivos), propõe-se a inserção da “mutabilidade” ao rol de atributos intrínsecos ao referido gênero (e, portanto, presentes em todas as suas espécies), apontando-se também critérios à sua mensuração qualitativa. À vista disso, este artigo também propõe avaliar a presença e a intensidade do atributo da mutabilidade em litígios coletivos que se constituam estruturais, buscando demonstrar a correlação existente entre a acentuação do grau de mutabilidade do litígio, a tendência à prospectividade das providências resolutivas e a relevância da flexibilidade dos procedimentos resolutivos para admissão de contínuas reavaliações das características e circunstâncias da situação litigiosa.
