El estado de derecho se ha convertido en todo para todos, lo que precisamente dificulta su definición. En lugar de intentar esa tarea, este artículo rastrea cómo el estado de derecho se ha desarrollado como un conjunto de prácticas de gobernanza específicas, tanto en la historia del derecho comparado como en los debates políticos recientes. Mientras que las tradiciones jurídicas nacionales han combinado ideas sobre los efectos restrictivos del derecho con concepciones normativas sobre la organización política, el debate político ha tendido a despolitizar el derecho por completo. Como resultado, se hizo posible que aspirantes a autócratas, decididos a socavar las limitaciones normativas del derecho, manipularan el sistema y utilizaran el derecho con fines autocráticos. No obstante, el estado de derecho está iniciando una nueva etapa a través de un movimiento que busca desprovincializar el derecho y reinsertarlo en normas transnacionales. Este estado de derecho, en un sentido amplio, se ha convertido en un nuevo referente para hacer que el poder político rinda cuentas a través del derecho.
