A trajetória do Estado de Direito

O Estado de Direito tornou-se um conceito abrangente, que pode ter significados diferentes para diferentes pessoas, o que justamente dificulta a sua definição. Em vez de seguir esse caminho, este artigo examina o desenvolvimento do Estado de Direito como um conjunto de práticas governamentais específicas, tanto na história do direito comparado quanto nos debates políticos recentes. Enquanto as tradições jurídicas nacionais combinaram ideias a respeito dos efeitos limitadores do direito com concepções normativas quanto à organização política, o debate de políticas públicas tende a despolitizar completamente o direito. Como resultado, possibilitou que autocratas aspirantes, determinados a enfraquecer as restrições jurídicas de natureza normativa, conseguissem manipular o sistema e utilizar a lei para fins autoritários. No entanto, o Estado de Direito está iniciando uma nova fase, por meio de um movimento que busca desparoquializar o direito de perspectivas estritamente nacionais e reinseri-lo em normas transnacionais. Esse Estado de Direito, em sentido amplo, tornou-se um novo parâmetro para responsabilizar o poder político.
