O perfil das Constituições contemporâneas

Este artigo analisa o perfil das Constituições contemporâneas. Busca investigar por que as Constituições contemporâneas têm sido chamadas de “Constituições transnacionais”. Seu propósito é oferecer uma resposta a essa questão por meio de resultados de vários importantes estudos empíricos realizados nos últimos anos, correlacionando esses achados com o processo constituinte participativo. Em outras palavras, investiga a relação entre o conteúdo das Constituições e a vontade popular. Conclui que a captura política aumenta sobremaneira o risco de o resultado do processo constituinte, por mais participativo que possa ter sido, ser bastante desapontador e decepcionante, com Constituições alienadas, enganosas, impopulares, prolixas e não duradouras. Por essa razão, conclui também ser necessária uma reflexão sobre como realmente deve ser um processo constituinte participativo, a começar pela própria ideia de participação.
