Suprema – Constitutional Studies Law Review welcomes articles for dossier on structural litigation
Suprema – Constitutional Studies Law Review is accepting articles for its seventh edition (Notice STF/SAE 01/2024) until March, 3rd. This edition will bring together articles on “Structural litigation in Constitutional Jurisdiction: challenges, limitations, and breakthroughs”. The thematic dossier will be the first of Justice Luís Roberto Barroso's term as President of the Federal Supreme Court (STF). It is planned to be launched in the first half of this year.
Structural litigation
The so-called structural litigations consist of claims arising from the way in which social structures operate, thus resulting systematically in the violation of rights. Despite of lacking a theoretical or conceptual background in Brazil, this type of litigation has become increasingly common in the country. Processes and structural cases seek to bind state powers, political agents and social actors to the purpose of transforming social realities that cause such violations of rights and guarantees.
These disputes reach the Judiciary under different forms and procedural techniques. So, the constitutional commitments require cooperation between the three branches of government, political agents, social organizations and affected vulnerable groups. The recognition and implementation of structural processes still have a long way ahead. As such, the issue deserves further legal debate.
Research lines
According to Suprema's editorial team, in charge of the thematic dossier organization, the articles should be guided by the following questions:
- Structural litigation, democracy, and efficiency in the protection of fundamental rights: in exercising the balance among other branches of the state, to what extent can the Judiciary use structural litigation to consolidate democratic projects by transforming political, economic, social, cultural and environmental realities?
- Theoretical contributions, conceptual frameworks, and Approaches in the field of structural litigation: what is meant by structural litigation? How can the legal field be organized to make this mechanism more accessible, clear and comparable to other procedural techniques?
- Institutional and social dialogues in the context of structural litigation: what are the means and techniques needed to make actions, litigation and structural processes more democratic, legitimate and efficient?
Articles
Articles for the thematic dossier must be original and unpublished and must not be under evaluation in other journals. Submissions must be put directly on the Suprema Website. All manuscripts will be peer-reviewed according to the double-blind system.
In addition to submissions for the thematic dossier, Suprema continually receives articles, reviews and translations on a rolling basis, all of which can be submitted through the same channel.
